1. Definitions
In these Terms and Conditions, the following terms have the meanings set out below:
- "Trellisvale", "we", "us", "our" — refers to Trellisvale, a service operating from 41 Ranong Road, Talat Yai, Mueang Phuket, Phuket 83000, Thailand.
- "Client", "you", "your" — refers to any individual or household that engages Trellisvale's services or accesses this website.
- "Services" — refers to the estate organisation, document support, and educational workshop services offered by Trellisvale, as described on our website and in service agreements.
- "Agreement" — refers to these Terms and Conditions, together with any service agreement or booking confirmation entered into between you and Trellisvale.
- "Materials" — refers to documents, records, keepsakes, and other items provided to us by you in connection with the delivery of our Services.
2. Acceptance of Terms
By engaging our Services, booking a workshop, submitting an enquiry through our website, or otherwise using our services, you agree to be bound by these Terms and Conditions.
You must be at least 18 years of age and have the legal capacity to enter into a binding agreement. If you are acting on behalf of another person or a household, you confirm that you have the authority to do so.
If you do not agree with any part of these Terms, you should not use our Services.
3. Service Description
Trellisvale provides non-regulated estate organisation and document support services, including:
- Continuity Information Workshops — educational sessions on how families generally structure their records and belongings for clarity and continuity.
- Linked Records Support — practical assistance in organising household documents and items into an inventory linked to named individuals.
- Estate Archive Companion — an ongoing service maintaining a comprehensive family record and keepsake archive over time.
Our Services are provided in Phuket, Thailand, and to households within travelling distance of our office. Remote engagements may be considered on a case-by-case basis. We do not provide legal, financial, or professional advisory services of any regulated kind.
4. Client Responsibilities
When engaging our Services, you agree to:
- Provide accurate and complete information relevant to the service you have requested
- Ensure that you have the right to share any Materials provided to us — including documents, records, and items belonging to or relating to other individuals
- Attend or facilitate sessions at the agreed time and location
- Not misuse our services for any unlawful purpose
- Not represent the outputs of our services as having legal authority or professional certification beyond what they are — organisational tools for household clarity
5. Intellectual Property
All content on our website — including text, design elements, and written materials — is the property of Trellisvale and may not be reproduced without our written consent.
The indexes, inventories, and archives we create on your behalf using your Materials are delivered to you for your personal household use. You retain ownership of your Materials at all times. Trellisvale retains no ongoing rights over Materials you provide.
6. Payment Terms
All prices are stated in Thai Baht (฿) and are inclusive of applicable taxes unless otherwise specified in writing.
- Payment is due in full prior to the commencement of each service or workshop session, unless agreed otherwise in writing.
- We accept bank transfer and cash payment at our office.
- Workshop bookings cancelled with fewer than 48 hours' notice may not be refunded.
- For project-based services, if Trellisvale is unable to complete an engagement due to circumstances within our control, a proportionate refund will be offered for work not yet completed.
7. Service Delivery Terms
Timelines for project completion are agreed at the outset of each engagement and are indicative. We will communicate promptly if circumstances require adjustment.
Changes to the agreed scope of a project — including additional materials or significant changes to the structure of an archive — may affect the timeline and price. We will discuss any such changes with you before proceeding.
All physical Materials will be returned to you at the conclusion of each session or project. We do not retain originals.
8. Confidentiality
We treat all Materials, personal information, and household details shared with us as confidential. We will not disclose your information to third parties except as required by law or with your prior written consent.
Our team members involved in your engagement are bound by confidentiality obligations consistent with this commitment.
9. Disclaimers
Trellisvale provides organisational and educational services only. We are not a law firm, notary, financial adviser, or any other regulated professional service. Nothing in our services constitutes legal, financial, or professional advice of any kind.
The outputs we produce — including indexes, inventories, and archive documents — are tools for household organisation and clarity. They do not carry legal force and should not be relied upon as substitutes for properly executed legal instruments.
10. Limitation of Liability
To the fullest extent permitted by law, Trellisvale's liability to you in connection with our Services is limited to the amount paid by you for the specific service in question.
We are not liable for any indirect, consequential, or incidental losses arising from the use of our services, including reliance on organisational outputs for legal or financial purposes.
We exercise reasonable care in handling physical Materials provided to us. In the unlikely event of loss or damage to Materials while in our possession, our liability is limited to the reasonable replacement cost of the item, if determinable.
11. Indemnification
You agree to indemnify and hold Trellisvale harmless from any claims, losses, or expenses arising from your breach of these Terms, your misuse of our services, or any claim by a third party that Materials you provided to us violated their rights.
12. Termination
Either party may terminate an engagement by giving reasonable written notice. For workshop bookings, notice must be given at least 48 hours before the session.
Upon termination, all Materials will be returned to you. Payment for work already completed is due in full. Sections of these Terms relating to confidentiality, disclaimers, and limitation of liability survive termination.
13. Dispute Resolution
These Terms and any disputes arising from them are governed by the laws of the Kingdom of Thailand, including the Civil and Commercial Code and applicable consumer protection legislation.
In the event of a dispute, both parties agree to first seek resolution through direct discussion. If an agreement cannot be reached informally within 30 days, the dispute may be referred to the competent courts of Phuket Province, Thailand.
14. General Provisions
- Entire Agreement: These Terms, together with any signed service agreement, constitute the entire agreement between the parties with respect to the subject matter.
- Severability: If any provision of these Terms is found unenforceable, the remaining provisions continue in full force.
- Waiver: Failure to enforce any provision does not constitute a waiver of the right to enforce it in future.
- Assignment: You may not assign your rights or obligations under these Terms without our written consent.
- Notices: Formal notices should be sent to [email protected] or to our registered address.
15. Changes to These Terms
We may update these Terms from time to time. When we do, we will revise the "Last Updated" date at the top of this page. Continued use of our Services after any update constitutes your acceptance of the revised Terms. We encourage you to review this page periodically.
